FDA and E-Cigarettes: If it’s not confusing, it’s not done right…..right?

Hello and thank you for stopping into the ACC Blog. As you most likely know there has been a lot happening in the electronic cigarette industry. Much of it has been pretty well gone over by not only us but a ton of other sources. Some of this information is pretty accurate. That being said there are some bits of mis-information floating around as well.

Today let’s talk about why there is so much mis-information and confusion around this whole FDA thing.  We will start by taking a look at the Draft document that was released May 10th, 2016 that started the industry down this ever changing and very confusing path.  ⇓

 

 

This 500 Page document looks intimidating, and it is! The shear number of pages and the amount of legal ease used is nearly mind numbing, and I know because I have read it from front to back multiple times at this point.

Our manufacturing plant is clean and safe. We feel confident that regardless of the standard that will be set, we will be just fine.

But what IS a draft document? Well according to the Black Law Dictionary (http://thelawdictionary.org) a draft document is; “a tentative, provisional, or preparatory writing out of any document.” That basically means that there is a lot of room for things to be interpreted, and that any part of it or all of it can change.  So ya, that would be a good reason for there to be more than one school of thought on the subject. In fact even some of the information that is being given out at the FDA hosted Office-1webinars is vague or incomplete.

Let me give you an example of what I am talking about. It’s pretty clear in the document that there will be standards applied to the manufactures of electronic cigarettes. I think standards are a good idea. ACC has always held ourselves to very high standards and we think that having standards is a reasonable request. Here is where things get more than a bit confusing though. The issue is that there have been no standards actually set. Since there has never been an e-cigarette standard. The industry is fairly new, so who knows what good standards should look like? How exactly do you comply with unknown standards though?

ProducingLines-1crop2Enter a slew of lawyers, regulatory experts and political allies/or enemies. It’s all enough to make a girls head spin. The thing is the standards will be figured out, and those in the industry that can, will comply, but until then the facts are a little muddy to say the least.Office-3

So be aware of everything you read and see when it comes to the next 24 months and the FDA. When in doubt just check us out.
