Extra! Extra! The FDA Electronic Cigarette Deeming May Be About To Be Turned Upside Down!

Glad to have you here, thank you so much for choosing to keep informed and up to date on things electronic cigarette related.  It is vital that information like this is spread fast and people like you are informed as to what is going on. This industry can only thrive with educated customers who understand and want to fight for their nicotine delivery rights. Remember electronic cigarettes contain nicotine and nicotine is an addictive substance. If you are a non smoker then stay a non nicotine user as well.  There is nothing fun about addiction.

That being said, if you or a loved one IS a smoker and currently addicted to nicotine, then have I got some potentially great news for you today!

As many of you may know last year there was a ton of activity around e-cigarettes at the federal level. Legislators both for and against the e-cigarette industry had a lot to say. That was especially true after the FDA released it’s new deeming rule in regards to electronic cigarettes.

The deeming rule, which was released in May and took effect in August of 2016 was as bad as it could be for the industry. These regulations via this deeming have the potential to cripple the e-cigarette market primarily by enforcing an “on market” grandfather date of Feb 7th 2007. If a product was not for sale at that time it will then have to go through a VERY expensive process that even most existing tobacco products have not been required to go through. To put that into perspective, we at A Clean Cigarette had the first electronic cigarette store in Michigan, we opened it in 2010! So a grandfather date of 2007 is useless to the industry as a whole. The Deeming rule does a bunch more as well but that date is the real kiss of death for many in the industry.

However, Congressmen Tom Cole (R-Okla.) and Congressmen Sanford Bishop (D-Ga.) both felt that this was not the best way to move forward (Insight as to why they feel this way can be found by clicking HERE) so they created the Cole-Bishop amendment of 2016. It did a bunch to re-word some of the more interesting parts of the FDA deeming but most importantly it moved the Grandfather date to Aug 21st, 2016.

The Amendment was pretty much abandoned at the end of 2016 and with it the hopes of many in the electronic cigarette industry.

BUT WAIT!!!

These two tenacious Congressmen have not given up! In fact, they are at it again and in a BIG way.

That’s right they have introduced a bill that while still leaving the FDA with the regulatory authority over e-cigarettes and e-cigarette standards, it clarifies a huge amount of the language, helps set deadlines for standards and most importantly, it moves the Grandfather date. That is HUGE!

It’s all very new and in fact, the bill itself is stamped Feb 10th 2017 @ 4:30 pm. So give me a bit of time to learn more about this. Keep checking back though, as I will be doing my best to keep our information as up to date as possible! Again, thank you and please share this information.
